The Family Project GmbH & Co KG
By registering, the customer makes a binding offer to The Family Project GmbH & Co KG to conclude a travel contract. The registration can be made in writing, verbally, by telephone or online. It is also made by the applicant for all travel participants listed in the registration. The booking of the tour only becomes binding for The Family Project GmbH & Co KG once it has been confirmed in writing to the tour participant. The travel participant is bound to his/her registration until acceptance by The Family Project GmbH & Co. KG, but for no longer than 16 days from the date of registration.
If The Family Project GmbH & Co. KG arranges programs of other tour operators or individual services, e.g. flights, hotel rooms, rental cars, etc., The Family Project GmbH & Co. KG is only responsible for the proper arrangement, not the service itself. The conclusion of the contract and its content are governed by the relevant statutory provisions and, where applicable, by the terms and conditions of the respective contractual partner.
Offers from The Family Project GmbH & Co KG are made to the best of our knowledge and belief. However, as The Family Project GmbH & Co. KG is dependent on third parties with regard to the availability of the respective services, individually prepared offers from The Family Project GmbH & Co. KG are also non-binding. Upon or immediately after conclusion of the contract, The Family Project GmbH & Co. KG will provide the customer with the travel confirmation. The Family Project GmbH & Co KG is not obliged to do so if the customer's booking is made less than seven working days before the start of the trip. Additional agreements (changes, additions, special requests, etc.) require express confirmation from The Family Project GmbH & Co KG in text form. If there is no express confirmation in text form on the booking confirmation, requests from the booking correspondence are only to be regarded as non-binding requests for which no guarantee can be given.
Unless otherwise agreed in individual cases, the flight price and a deposit of 30% of the land price plus any premium for travel cancellation insurance are due immediately upon receipt of the written travel confirmation and handover of the security certificate within the meaning of Section 651 k (3) BGB. Payment of the remaining travel price must be received 6 weeks before departure, unless otherwise agreed in individual cases. For bookings made less than 6 weeks before departure, the full travel price is due and payable immediately. The travel documents will be prepared after receipt of payment by The Family Project GmbH & Co KG and sent approximately 3 weeks before departure. Credit card payment is possible, a transaction fee of 2.5% will be charged for American Express cards.
The scope of the contractual services is set out in the individual offer prepared by The Family Project GmbH & Co KG. Changes must be recorded in writing. The flight schedule is designed by the contracted airline and state coordinating authorities. Short-term changes to flight times, routing and aircraft are sometimes unavoidable. No claims for damages against The Family Project GmbH & Co KG can be derived from this. Travel participants are also obliged to inform the local branch of the airline of the exact time of the return flight at least two days before the return flight date and to have the return flight confirmed.
The price on the personal offer is valid. The Family Project GmbH & Co KG reserves the right to adjust the price agreed in the travel contract in the event of an increase in transportation costs or charges for certain services such as port or airport fees or a change in the exchange rates applicable to the trip in question. The Family Project GmbH & Co KG is obliged to inform the tour participant immediately of any changes or deviations. In the event of an increase in the tour price of more than 5% due to an increase in transportation costs and charges for certain services, such as port or airport charges, the customer has the right to withdraw from the contract. In the event of a change in exchange rates after the conclusion of the travel contract, the tour price may be increased to the extent that the tour has become more expensive for The Family Project as a result. Should the tour price increase by more than 5% for currency reasons, the right of withdrawal shall lapse. A price increase that is demanded from the 20th day before the agreed start of the trip is invalid. An increase is only permissible if there are more than 4 months between the conclusion of the contract and the agreed travel date and the circumstances leading to the increase had not yet occurred prior to the conclusion of the contract and were not foreseeable for The Family Project GmbH & Co KG at the time of conclusion of the contract.
In the event of withdrawal by the travel participant, the following flat-rate withdrawal costs are due: 30% of the land service and the entire flight price if more than 8 weeks before the start of the trip, 100% of the travel price from 8 weeks before the start of the trip or in the event of no-show. In the case of round trips and safari trips, the following flat-rate cancellation costs are due: Up to the 71st day before the start of the trip, 30% of the land service and the full airfare, from the 70th day or in the event of no-show 100% of the tour price. Should The Family Project GmbH & Co. KG incur higher costs in individual cases due to the respective service provider, The Family Project GmbH & Co. KG is entitled to pass these on to the customer with the corresponding proof. The Family Project GmbH & Co KG will attempt to calculate the respective amount of damages with the respective service providers. This will then be passed on to the travel participant with the addition of a 10% processing fee from the total amount. The key date for calculating the deadline is the date of receipt of the written declaration of withdrawal. Changes to the date, destination or accommodation are only possible by withdrawing from the travel contract and making a new booking. The travel participant may be replaced by a third party up to the start of the trip. The costs are a flat rate of Euro 100 per person. The Family Project GmbH & Co. KG reserves the right to object to the change if the person does not meet special travel requirements, statutory regulations or official orders to the contrary. In the case of flight services, the rebooking fees are to be borne by the customer.
If the travel participant does not make use of services advertised in the travel program, or does not make use of them in part, this shall not give rise to any claims for compensation.
If the tour participant disrupts the execution of a tour to such an extent that immediate cancellation of the contract is justified, The Family Project GmbH & Co KG may withdraw from the contract without notice. In this case, The Family Project GmbH & Co KG retains the full claim to the travel price. If the trip is significantly impaired as a result of force majeure unforeseeable at the time the contract was concluded, both parties may terminate the contract. If this occurs, The Family Project GmbH & Co. KG can demand appropriate compensation for the services already provided or those still to be provided at the end of the trip. Any additional costs incurred for return transportation will be shared equally by both parties.
If a service is not provided in accordance with the contract, the travel participant may demand redress. He must notify The Family Project GmbH & Co KG of the defect immediately by fax or email. The Family Project GmbH & Co. KG can refuse to remedy the situation if the effort involved is disproportionate. If The Family Project GmbH & Co KG does not remedy the situation within a reasonable period of time, the travel participant can remedy the situation themselves. The tour participant can claim a reduction in the tour price for the costs of the remedy and the duration of the non-contractual provision of services by The Family Project GmbH & Co KG. The prerequisite for this is that The Family Project GmbH & Co. KG has been informed of the defect immediately. The deadline for rectifying the defect or informing The Family Project GmbH & Co. KG does not apply if immediate remedial action is required in the interests of the travel participant.
The liability of The Family Project GmbH & Co. KG is limited to twice the travel price, insofar as damage to the traveler is not caused intentionally or through gross negligence or due to the fault of the service provider. If The Family Project GmbH & Co. KG only acts as an agent, The Family Project GmbH & Co. KG is not liable.
The customer is obliged to cooperate in the event of service disruptions within the framework of the statutory provisions in order to avoid or minimize any damage. In particular, the customer is obliged to inform the local tour guide immediately of any complaints. The tour guide shall be instructed to take remedial action if this is possible. If no tour guide is available, the complaint must be made to the respective service provider.
Claims due to non-contractual fulfillment of the trip must be made in writing within one month of the end of the trip. Claims can only be asserted after the deadline if the travel participant was prevented from meeting the deadline through no fault of his own. Claims become time-barred after six months.
The Family Project GmbH & Co KG will inform the travel participant of the passport, visa and health regulations of which it is aware, applying the necessary duty of care. It is assumed that the participant will endeavor to adapt to the relevant regulations or changes at short notice. If the above-mentioned regulations are not complied with by the travel participant, The Family Project GmbH & Co. KG may charge him/her with corresponding cancellation fees.
The Family Project GmbH & Co. KG is not liable for the timely issuance and receipt of necessary visas by the respective diplomatic representation if the customer has commissioned The Family Project GmbH & Co. KG with the procurement, unless The Family Project GmbH & Co. KG is responsible for the delay. The customer is responsible for complying with all regulations that are important for the execution of the trip. You must allow approximately eight weeks to obtain visas etc. from the relevant authorities. All disadvantages, in particular the payment of cancellation costs arising from non-compliance with these regulations, shall be borne by the customer, unless they are due to culpable misinformation or non-information by The Family Project GmbH & Co KG. The customer must ensure that the passport or identity card has a sufficient period of validity for the trip. In particular, a separate travel document (children's passport, passport or identity card) is required for trips abroad from 2012 onwards, even for children from birth.
The customer should obtain information about infection and vaccination protection and other prophylactic measures in good time; if necessary, medical advice should be sought about thrombosis and other health risks. Reference is made to general information, in particular from health authorities, travel medicine information services or the Federal Center for Health Education. Various countries require certain vaccination certificates, which must not be younger than eight days and not older than three years (smallpox) or ten years (yellow fever). Such vaccination certificates must also be presented to German authorities if the customer is returning from certain countries (e.g. Africa, Middle East). The customer can contact The Family Project GmbH & Co KG for the relevant information.
Customs and foreign exchange regulations are handled very strictly in various countries. The customer should obtain detailed information about this and comply with the regulations.
Unless expressly stated otherwise, the travel prices shown do not include travel insurance with the exception of the insurance certificate. The Family Project GmbH & Co KG recommends in particular the conclusion of travel cancellation costs, travel interruption, travel liability, foreign health and travel accident insurance. An insurance contract is concluded exclusively between the customer and the specified travel insurer. The premiums for insurance are not part of the travel price and are generally due for payment immediately upon conclusion of the insurance. Subsequent conclusion of travel cancellation insurance after binding conclusion of the travel contract is only possible to a limited extent in some cases.
As the brochure is printed before the trip is booked, the sports facilities offered may have changed. The booking confirmation is decisive for dates. Hotel descriptions are based on information provided by the hotels and may change at short notice.
Additional agreements (amendments, additions, special requests, etc.) must be made in writing. This also applies to any amendment or waiver of the text form requirement. The place of fulfillment and jurisdiction is Mühldorf am Inn, Germany. The contractual relationship between the customer and The Family Project GmbH & Co KG is subject to the law of the Federal Republic of Germany.
